What Is Probate of a Will?

Probate of a will is the legal process where the court validates the deceased person’s will, appoints the executor (personal representative), and oversees distribution of assets. Assets such as real estate or bank accounts typically must go through probate unless they pass outside the estate through joint ownership or beneficiary designation

Do All Estates Need Probate?

Not every estate must undergo full probate. Alabama offers summary distribution for smaller estates that meet certain criteria. Even so, estates involving real estate or higher-value assets generally require probate administration

  • A will must be filed for probate within five years of the testator’s death to remain effective

  • The estate must remain open in probate for at least six months after probate begins

  • The executor (named in the will) or an administrator appointed by the court must file a petition to open the probate estate with the county probate court where the decedent resided
